
Plan It® Terms and Conditions
These Plan It Terms and Conditions (“Plan It T&Cs”) govern the use of the Plan It payment option feature offered by AMEX (Middle East) B.S.C. (c) (“AEME” or “our”) to the card member who accepts these Plan It T&Cs (“Card Member”, “I”, “you”, or “your”). Card Members should review these Plan It T&Cs thoroughly to understand their rights and obligations related to the usage of Plan It. In the event of any contradiction between these Plan It T&Cs, the Schedule of Fees and Charges or the Card Member Agreement, these Plan It T&Cs shall prevail to the extent of such inconsistency. Any term used in this Plan It T&Cs document, but not expressly defined herein, shall have the meaning given to it in the Card Member Agreement.
The Plan It payment option is designed to allow Card Members to convert eligible Transactions into instalments.
By converting a Transaction into a Plan, Card Members agree to abide by the terms and conditions specified herein.
Interpretation
1. Part 1 – Definitions
In this section, you will find definitions of key terms and concepts relevant to the Plan It feature. Unless the contrary is expressly indicated, the following words and expressions shall have the meanings set out hereunder.
1.1. “Card” – means the credit card issued by AEME to the Card Member, and includes Basic, Supplementary, and Replacement Cards.
1.2. “Card Members” – means “The person in whose name a Card is issued to charge Transactions including Cash withdrawals to the Account, the debtor on the Account.
1.3. “Minimum Payment Due” – means the amount indicated in the Card Member’s Statement of Account, which shall also include the Monthly Plan Payments.
1.4. “Mobile App” – means the Amex MENA mobile application.
1.5. “Monthly Plan Payment” – means the monthly amount payable by the Card Member for the duration of the Tenor. For the avoidance of doubt, the Monthly Plan Payment is the sum of the monthly principal repayment amount and the Plan It Interest.
1.6. "Online Services" – means the online platform to manage your Card Account digitally.
1.7. "Plan" – means an instalment plan selected by the eligible Card Member whereby their selected Transaction is repaid in equal monthly instalments over an agreed Tenor by the Card Member.
1.8. "Plan It" – means a payment option feature that provides flexibility to repay the value of a converted Transaction in equal Monthly Plan Payments.
1.9. "Plan It Interest" – means a monthly interest charge, as set forth in the Schedule of Fees and Charges, and calculated based on the Reducing Balance method, applied to a Transaction that has been set up as a Plan by the Card Member.
1.10. "Plan It Outstanding Amount” - means the remaining sum of all unpaid Monthly Plan Payments within a Plan.
1.11. "Reducing Balance" – means the method of calculating interest charges set out in the Schedule of Fees and Charges.
1.12. "Tenor" – means the number of months the Transaction is repaid under the terms of the Plan.
1.13. "Total Plan Amount" – means the combined sum of all Monthly Plan Payments within a Plan.
1.14. "FeeBack" – means a feature where a Card Member of certain cards only have the option to get the annual membership fee back when they meet specified conditions as mentioned in the terms and conditions of these Cards.
2. Part 2 – General Terms
This section contains additional general terms that apply to the Plan It feature.
2.1. AEME reserves the right to modify, amend, or update these Plan It T&Cs at its sole discretion. Any changes will be communicated by AEME to Card Members.
2.2. AEME may, in its sole and absolute discretion and without notice, withdraw or revise this Plan It feature. This will have no impact on any existing Plan held by a Card Member.
2.3. AEME reserves the right to limit the number of Plans that a Card Member can set up at any time.
2.4. These Plan It T&Cs governing your Plan are in addition to the terms & conditions of the Card Member Agreement governing Card usage.
2.5. All questions or disputes regarding eligibility for Plan It will be resolved by AEME in its sole discretion. Any such decision on all matters relating to conversion of Transactions to a Plan shall be final, binding and conclusive.
2.6. AEME’s failure to enforce any term or condition under these Plan It T&Cs does not constitute a waiver of that term or condition by AEME.
2.7. AEME's obligations for Plan It are subject to any restriction or limitation imposed by any regulatory, judicial or administrative authority with jurisdiction over AEME, and AEME will not be liable to the extent any decision, direction, order or determination by such body prohibits or restricts AEME's ability to comply with the terms and conditions of these Plan It T&Cs.
2.8. Card Members release and discharge AEME from any and all liability resulting from any unauthorized human intervention, or any other cause, including but not limited to malfunction of any computer component, software or communication line, any loss or absence of network communication, any faulty, incomplete or unintelligible transmissions which could affect a Card Member’s use of the Plan It feature.
2.9. AEME reserves the right to request a valid national ID or passport. If the Card Member refuses AEME’s request without providing a justifiable reason then AEME may deem the Card Member ineligible for Plan It.
